General conditions of sale

The general conditions of sale concern the purchase of products on the website www.pavonitalia.com of Pavoni Italia S.p.A. - Via Enrico Fermi SN - 24040 Suisio BG - Italy - Fully paid-up share capital € 2,408,000 - VAT number 00884290164 - registered with the REA of Bergamo n. 180918.
Confirmation of the order by the buyer implies acceptance of these general conditions of sale.
These general conditions of sale are governed by the Consumer Code (Legislative Decree no. 206/2005), section II, Distance contracts (articles 50 - 67) and by the rules on electronic commerce (Legislative Decree no. 70/2003).
Pavoni Italia S.p.A. reserves the right to unilaterally modify the conditions of sale and publish an updated or modified version thereof. Pavoni Italia S.p.A. has no obligation to specifically inform the user of any changes. Access to the site constitutes acceptance of the published terms and conditions.
 

1. Orders

1.1 Product offer

The products and their images are presented in accordance with legal requirements and as accurately as possible. Any differences between what is published on the website and the products purchased, if they do not concern their essential characteristics and do not affect their quality, will not be able to justify a cancellation of the order or a refusal to deliver.
Pavoni Italia S.p.A. also reserves the right to change the data relating to products and prices shown on the website without prior notice.

1.2 Acceptance of the order

For the buyer, the order is completed at the time of confirmation, for Pavoni Italia S.p.A. starting from the validation of the payment.

1.3 Minimum order

Pavoni Italia S.p.A. sets a minimum amount per order.

1.4 Availability of products

The availability of the products refers to the actual availability at the time the buyer places the order.

Even after sending the order confirmation email, there may be cases of partial or total unavailability of the goods. In this case, the buyer will be informed by email or telephone and can agree with Pavoni Italia S.p.A. to cancel the order for the unavailable product or agree on a different delivery date. If the buyer requests cancellation, Pavoni Italia S.p.A. will refund the amount paid.

2. Prices and payment methods

2.1 Prices

Product prices do not include shipping costs. Shipping costs are applied at check-out.

Prices are subject to change at any time. The changes do not affect orders for which an order confirmation has already been sent.

Where there is an obvious error in the price of the products indicated on the site, Pavoni Italia S.p.A. will notify the buyer as soon as possible, allowing confirmation of the order at the right amount or cancellation. In any case, there will be no obligation for Pavoni Italia S.p.A. to supply what is sold at the lower price incorrectly indicated.

2.2 Terms of payment

Pavoni Italia S.p.A. uses third-party tools for processing payments and does not in any way enter into contact with payment data provided - such as those relating to the credit card. Should the owner of each of these third-party instruments refuse the payment authorization, Pavoni Italia S.p.A. will not be able to provide the service and will not be responsible for any delay or failure to deliver the products.

3 Shipping and delivery

3.1 Shipping methods

The delivery terms are intended, according to INCOTERMS 2010 regulations:

  • CPT - Carriage paid to – EU buyers

  • DAP - Delivery at place – non-EU buyers*

*For non-EU countries, customs and / or import charges must be paid separately to the courier. These costs are not calculated in the total order, but will be charged when the package reaches the country of destination, therefore the additional costs related to customs clearance are the sole responsibility of the buyer.

3.2 Shipping time

Delivery times may vary depending on the recipient’s country. Delivery can take place within 15 working days, barring unforeseen customs delays.

Products not available in stock will be restocked in stock within 30 working days, subject to exceptions. For more information, you can contact our customer service.

3.3 Shipping costs

Delivery costs vary according to destination and are intended to be paid by the buyer as adequately highlighted in the order issue phase (see 3.1 “shipping methods”). 

3.4 Delivery with reserve right

Upon receipt of the material, before signing the document to the courier, the buyer undertakes to check the physical condition of the packaging and the number of packages compared to what is indicated in the shipping documents. In the event of inconsistencies, the buyer must sign "RECEIVED WITH RESERVE" at the same time as the delivery, indicating the reason on the courier's delivery document. In the absence of this reserve, Pavoni Italia S.p.A. will not be responsible for any damage to the goods delivered.

3.5 Restrictions on delivery

If the order is destined for France, the "Arrêté du 17 avril 2019 portant suspension de la mise sur le marché des denrées containing the additif E 171 (dioxyde de titane - TiO2) has come into force with effect from 1 January 2020. If your order needs to be shipped to others extra EU countries your order may be blocked due to legislative restrictions in force in the country of destination of the order or to restrictions imposed by the transporter.

If delivery is not possible, the order will be sent to the courier's depot. In this case, a notice will specify the place where the order is located and how to agree on a new delivery.

If the delivery cannot take place for reasons not attributable to Pavoni Italia S.p.A., after 30 days from the date on which the order is available for delivery, the contract is considered terminated. The amounts paid will be returned including delivery costs with the exclusion of any additional costs. The transport resulting from the termination of the contract may have additional costs that will be borne by the buyer.

4. Right of withdrawal

The buyer, as defined "Consumer" pursuant to Article 3 of the Consumer Code, has the rights under art. 64 of the Consumer Code within the limits set by this legislation, therefore he is granted the right to withdraw from this contract, without obligation to indicate the reasons and without having to pay any penalty, within 14 working days from the day of receipt of the goods. subject of the contract itself.

4.1 Method of exercising the right of withdrawal

The right of withdrawal is exercised by sending a written communication to Pavoni Italia S.p.A. within the indicated term of 14 days from receipt of the goods.

The communication can be sent, within the same term, by e-mail to customercare@pavonitalia.com.

If the buyer intends to make use of the right of withdrawal, he will have to provide at his own expense to return the goods covered by the contract within 14 working days from the date of receipt of the goods, sending them to the same address to which he is required to send written notice of withdrawal.

4.2 Condition for the exercise of the right of withdrawal

The substantial integrity of the good covered by the contract and its packaging as well as the original accompanying documents (receipt / invoice) is an essential condition for exercising the right of withdrawal.

4.3 Method of return

To return the goods, the buyer can use an ordinary postal package or rely on a courier in Free Port. Pavoni Italia S.p.A. will refund the buyer by bank transfer upon the recepipt of the goods. The buyer must provide Pavoni Italia S.p.A. with the bank details necessary for the reimbursement.

The refund only concerns the value of the returned item. Transport costs and duties are not refundable in any way.

5. Privacy and processing of personal data

The buyer's data are processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the appropriate section containing the information pursuant to art. 13 EU regulation 2016/679 (see our privacy policy).

6. Jurisdiction and competent court

Any dispute relating to the application, execution, interpretation and violation of this contract is subject to Italian jurisdiction. For any dispute that may arise between the parties in relation to the conclusion, validity, interpretation and execution of this contract, the Court of Bergamo (Italy) will be competent.
